Contract specifications
6. Type of contract: Fixed price.
7. Contract description: The procurement entails a service contract in 2
parts:
1) a short-term (6 months) study part, to draw up specifications for work
to be carried out in 4 departments of the country (North, Centre, South
and Grand'Anse) involving:
— school rehabilitation works,
— construction of new buildings.
2) A longer-term (approximately 12 months) supervision part, to be carried
out in close collaboration with engineers from the Direction du génie
scolaire (Schools engineering directorate) and involving supervision of
these works.
8. Number and titles of lots: Not applicable.
9. Maximum budget available: EUR 400 000.
10. Any additional services: The contracting authority does not plan to
extend the duration and/or object of the project.
Conditions for participation
11. Eligibility: Participation in contract procedures is open on equal
terms to natural persons and legal entities (irrespective of whether they
are taking part as individuals or as part of a grouping (consortium) of
tenderers) from the ACP countries and the Member States of the European
Union who contribute to the 9th European Development Fund (Belgium,
Denmark, Germany, Greece, Spain, France, Ireland, Italy, Luxembourg,
Netherlands, Austria, Portugal, Finland, Sweden, United Kingdom), and also
to international organisations as authorised by the instruments applicable
to the programme under which the contract is financed (see also point 30).
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All the
members of a consortium (i.e. lead company and all other members) shall be
jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, the application concerned will be automatically
disqualified (in particular, the application from the whole consortium
where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit 1 application irrespective of whether they take part as a sole
legal entity, or as a lead company or member of a consortium submitting an
application. Should a natural person or legal entity submit more than 1
application, all the applications involving said party will be
disqualified.
14. Prohibition on alliances between shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted procedure.
15. Grounds for exclusion: Candidates must sign and enclose with their
application the statement provided in the standard application form
confirming that they are not in any of the situations described in section
2.3.3 of the Practical Guide to contract procedures for EC external
actions. The Practical Guide to contract procedures for EC external

16. Subcontracting: Up to 20 % of the contract value may be
subcontracted.
17. Number of candidates invited to tender: There must be at least 4, but
no more than 8, candidates on the shortlist.
Provisional schedule for activities
18. Scheduled date for dispatch of invitations to tender: 30.7.2008.
19. Scheduled date for commencing activities: Study part: 25.11.2008,
supervision part: 4.11.2009.
20. Initial contract length, and possible extension: Study part: 6
months.
Supervision part: length of the works performance period: approximately 12
months (see terms of reference).
Selection and award criteria
21. Selection criteria: The following selection criteria will be applied
to candidates. Where applications are submitted by a consortium, then the
criteria will apply to the consortium as a whole.
(1) Candidates' economic and financial capacity:
— candidates' average annual turnover for the past 3 years, excluding the
present contract, must be at least EUR 500 000,
— cash and cash equivalents at the beginning and end of the financial year
must be in surplus, overall.
(2) Candidates' professional capacity:
— at least 10 of the candidates' staff (civil engineers and architects)
must be currently working in fields relevant to this contract,
— at least 20 % of those employees working this year for candidates in
fields connected with this contract must be on permanent contracts.
(3) Candidates' technical capacity:
— candidates must have obtained good results in the past 3 years for at
least 2 projects where the budget was at least equivalent to the budget
for this contract and where the fields involved were connected with those
in this contract.
Economic operators may, if necessary and for this contract, make use of
the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available.
Consortia of economic operators may make use, on the same terms and
conditions, of the capacities of other members of their consortium or
other bodies. Such bodies (e.g. economic operators' parent companies) must
observe the same eligibility rules, notably regarding nationality, as
economic operators themselves.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these candidates'
applications will need to be re-examined to determine which 8 applications
for the invitation to tender are the most suitable. Only the following
factor will be considered in the re-examination: the number of specific
study and supervision projects successfully carried out by service
providers on behalf of EDF National Authorising Officers over the past 5
years.
22. Award criteria: The criteria are specified in the invitation to
tender dossier appended to the letter of invitation to tender which will
be sent to shortlisted candidates.
Application submission procedures
23. Final date for submission of applications: 1.9.2008 (13:00), local
time, or if this falls on a public holiday in the Republic of Haiti, the
first working day after this date.
Applications received after this deadline will be rejected.
24. Application submission procedures and information to be supplied: The
standard application form must be used for applications. This form is
available from the following web address:
http://europa.eu.int/comm/europeaid/index_fr.htm. The clauses and format
of this form must be strictly adhered to. Any application which fails to
comply with these provisions will be automatically rejected.
Additional documentation (brochure, letter, etc.) enclosed with the
application will not be considered.
25. Procedures for dispatch of applications: Applications (originals)
must be submitted exclusively to the EDF National Authorising Office in
the Republic of Haiti, and 1 copy sent to the Delegation of the European
Commission in the Republic of Haiti:

given hereafter in return for a signed and dated acknowledgement of
receipt; original application documents must go to the National
Authorising Office and 1 copy thereof to the Delegation:

The contract title and the contract notice number (see point 1) must be
clearly marked on the envelope containing the application and must be
quoted in all subsequent correspondence with the contracting authority.
Applications submitted in any other way will not be considered.
26. Amendments to or withdrawal of tenders: Tenderers may amend or
withdraw their tender by giving notice thereof in writing before the final
date for submission of tenders. Tenders cannot be amended once this
deadline has passed.
Notice of amendments to or the withdrawal of a tender must be drawn up and
sent as per the instructions given in point 25. The word 'Modification'
(amendment) or 'Retrait' (withdrawal), as applicable, must be written on
the outside envelope.
27. Working language: All correspondence concerning this invitation to
tender procedure and contract must be in French.
28. Additional information: Candidates must enclose the following
documents with their application form:
— certified true copy of the memorandum and articles of association,
— official incorporation certificate,
— copy of the balance sheets for the past 3 years.
29. Date of publication of the corresponding contract forecast:
29.2.2008.
30. Legal basis: ACP-EC Cotonou Agreement, signed on 28.6.2000.
Decision No 2/2002 of the ACP-EC Council of Ministers of 7.10.2002
regarding the implementation of Articles 28, 29 and 30 of Annex IV to the
Cotonou Agreement and its Annex.
