Contract specifications
6. Contract description: The contract is for the delivery and
commissioning in Yaoundé, including after-sales service, of 12 lorries; 10
of these must be standard lorries to transport supplies to Cameroon's 10
central prisons, and 2 must be specially adapted — as per the diagram
provided — for the transport of prisoners of Yaoundé and Douala central
prisons.
7. Number and titles of lots: Lot 1: 10 lorries for the transport of
supplies.
Lot 2: 2 specially-adapted lorries for the transport of prisoners.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open
on equal terms to natural persons and legal entities (irrespective of
whether they are taking part as individuals or as part of a grouping
(consortium) of tenderers) from the ACP countries and the Member States of
the European Union who contribute to the European Development Fund, and
also to international organisations as authorised by the instrument
applicable to the programme under which the contract is financed (see
point 22). All the goods supplied under this contract must originate in 1
or more of these countries.
9. Grounds for exclusion: Tenderers must sign and submit the declaration,
included with the tender form for a supplies contract, confirming that
they are not in any of the situations listed in section 2.3.3 of the
Practical Guide to contract procedures in the context of external actions.
10. Number of tenders: Tenderers cannot submit more than 1 tender per
lot. Tenders for part of a lot will not be considered. Tenderers may state
in their tender whether they would grant a discount should they be awarded
several lots. Tenderers cannot submit a variant tender in addition to
their tender for the supplies required in the invitation to tender
dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee for EUR 9
000 for lot 1 and EUR 2 000 for lot 2 when they submit their tender(s).
This will be returned to unsuccessful tenderers once the invitation to
tender procedure has been completed and to the successful tenderer(s) once
the contract has been signed by all parties. This guarantee will be drawn
on if the tenderer does not honour all the obligations stipulated in the
invitation to tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: There are no plans for a briefing.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Implementation period: Delivery is required within 60 days of the
contract being signed by all parties.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. Where tenders are submitted by a consortium, these criteria
will apply to the consortium as a whole.
(1) Tenderers' economic and financial capacity (based on point 3 of the
tender form for a supplies contract):
(a) tenderers' average annual turnover must exceed EUR 600 000;
(b) cash and cash equivalents at the beginning and end of the financial
year must have been positive.
(2) Tenderers' professional capacity (based on points 4 and 5 of the
tender form for a supplies contract):
(a) tenderers must have the relevant professional certification for this
contract (e.g. exclusive commercial representation);
(b) tenderers must have a minimum of 15 permanent employees.
(3) Tenderers' technical capacity (based on points 5 and 6 of the tender
form for a supplies contract):
(a) tenderers must have successfully carried out at least 2 contracts in
the past 3 years with a budget of at least that of this contract;
(b) tenderers must provide proof of their capacity to provide an
after-sales service, or arrange for one to be provided, in Yaoundé, Douala
and several other provincial capitals in Cameroon, either by ownership of
maintenance workshops and stocks of spare parts, or by showing legal
cooperation agreements with providers of these technical services.
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. These
bodies must comply with the same eligibility rules, in particular
regarding nationality, as the economic operator in question.
17. Award criteria: The only award criterion for this contract is price.

The standard tender form for a supplies contract must be used to draw up
tenders. This form can be found in the invitation to tender dossier, and
its clauses and format must be strictly adhered to.

quoting the publication reference given in point 1. They must be sent to
